What alternative sanctions can CMS impose on labs?
Answer:
According to updates to the State Operations Manual (SOM), Chapter 6 Special Procedures for Laboratories, in place of or in addition to applying a principle sanction, the Centers for Medicare & Medicaid Services (CMS) is now capable of applying one or more of the following alternative sanctions:
- Directed PoC (dPoC) and directed portion of a PoC (dPPoC);
- State onsite monitoring; and/or
- Civil money penalty (CMP).
