Question:

How is CMS considering changing the laboratory DOS exception mentioned in last week’s question?

Answer:

The Centers for Medicare & Medicaid Services (CMS) is considering three primary options to modify the laboratory date of service (DOS) exception discussed in last week’s question:

  • “Changing the test results requirement at 42 CFR 414.510(b)(5)(iv);
  • Limiting the laboratory DOS exception at 42 CFR 414.510(b)(5) to ADLTs; and/or
  • Excluding blood banks and blood centers from the laboratory DOS.”
